§ 45-1. Manner of depositing refuse from private dwellings.

All refuse to be removed from private dwellings by the Village, except as specified below, shall be deposited in a refuse container, clearly marked with the name of the homeowner, in the following manner:

    1. Combustible refuse, including food, plastic and non-bulk paper items, shall be put in a suitable plastic bag, tied securely, and the bag or bags placed in a separate, tightly-closed refuse container.
    2. Noncombustible refuse, other than items to be recycled, including mirror glass, crockery and pressurized cans, shall be cleaned and placed unbagged in a separate marked and covered refuse container.
    3. Glass jars and bottles, metal containers other than pressurized cans or cans formerly containing combustible substances or other glass or metal products designated as recyclable items shall be placed, unbagged, in a separate marked and covered refuse container for collection by the Village.
    4. Quantities of newspapers, cartons and bulk paper items shall be securely bound in bundles with cord, twine or tape. The sum of the length, the width and the height of such bundles shall not exceed five (5) feet.
    5. Bulk items, including large appliances, bicycles, furniture and bundles larger than those specified in subsection C above will not be removed by the Village. Such removal shall be made by individual arrangement with the Village cartage contractor. Rates for such service shall be subject to regulation by the Board.
    6. Cleaned cans or other containers formerly containing combustible substances such as paint or petroleum products shall be placed unbagged in a separate container for removal by the Village.
    7. All refuse left for removal by the Village shall be placed adjacent to, but not upon, village walks. All containers, bags and bundles shall be securely covered or tied. The Board shall designate the day or days of the week on which refuse shall be collected.
    8. The owner, lessee and any other occupant of any premises shall be responsible for compliance with the provisions of this section with respect to all refuse originating in, discarded from or found in refuse containers relating to such premises. Any violation of such provisions evidenced by the condition of refuse found on any premises or in any container belonging to or in use by the owner, lessee or other occupant shall be presumed to have been committed by, or otherwise to be the responsibility of, such person or persons in the absence of evidence to the contrary. However, during any period of occupancy of any premises pursuant to a lease of more than one (1) month's duration, such presumption shall not apply to an owner not in possession or occupancy. § 45-2. Manner of depositing refuse from other dwellings.

All refuse to be removed by the Village from other than private dwellings shall be deposited in a durable refuse container in the manner set forth in § 45-1 herein, except that cartons and debris too large to be placed conveniently in a covered container must be stacked and covered with a weatherproof tarpaulin.

 

§ 45-3. Brush removal.

Except as the Board may by resolution permit, no brush, grass, wood cuttings or other natural vegetation shall be removed by the Village. Such removal shall be made by individual arrangement with the Village cartage contractor. Rates for such service shall be subject to regulation by the Board. Such vegetation may be removed by a private landscaper as a part of a landscaping job and not as a separate service. All such material left for removal shall be securely bundled and tied with cord or twine.

 

§ 45-4. Unauthorized disposal prohibited.

Waste and refuse removal shall be performed only in accordance with the provisions of this chapter. No person shall dump or otherwise improperly dispose of any refuse, nor deposit household refuse, in public trash containers within the village. No person shall enter upon any Village-owned area used for the disposal of refuse without the written permission of the Board or its agent, or as otherwise provided by this chapter. No person shall dump or otherwise dispose of any refuse, debris, or other waste materials in such manner as to create a health or safety hazard. No person shall dump or otherwise dispose of any such materials on any property other than his own without the written consent of the owner of such property. Persons responsible for the improper disposal of any waste materials shall be liable for the costs incurred in curing or abating such violation, if any.

 

§ 45-5. Regulations. [Added 6-9-1990 by L.L. No. 8, 1990]

The Board may adopt such reasonable regulations as it may from time to time deem necessary to promote the health and safety of village residents in connection with the collection and disposal of refuse.
